El Tribunal Supremo ha confirmado en sus Sentencias de 8, 10 y 21 de abril de 2025 que las retribuciones percibidas por militares españoles destinados en misiones internacionales —concretamente, en operaciones de la ONU en el extranjero y a bordo de buques en aguas internacionales bajo mando de la OTAN— están exentas del IRPF, de acuerdo con lo previsto en el artículo 7.p) de la Ley del IRPF.

Esta jurisprudencia del Tribunal Supremo supone un importante reconocimiento del derecho de los militares españoles a no tributar en IRPF por los rendimientos obtenidos por los trabajos efectuados en el extranjero durante estas misiones.

En consecuencia, aquellos militares españoles que hayan estado desplegados en este tipo de misiones internacionales, además de que, a partir de ahora, no deben incluir en su declaración de IRPF estas rentas derivadas de los trabajos propios de su cargo o función efectuados en el extranjero, PUEDEN SOLICITAR LA RECTIFICACIÓN DE SUS AUTOLIQUIDACIONES DEL IRPF DE EJERCICIOS NO PRESCRITOS1 Y RECLAMAR LA DEVOLUCIÓN DE INGRESOS INDEBIDOS.
